Ravinder Singh @ Varinder Singh v. State Of Punjab
IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH CRM-M-6728-2024 Date of decision: July 10th, 2024 Ravinder Singh @ Varinder Singh .....Petitioner
Versus
State of Punjab .....Respondent
CORAM:
HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL
Present:
Mr. Malkiat S. Hundal, Advocate for the petitioner.
Mr. Amit Rana, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Prayer in this (second) petition is for grant of anticipatory bail to the petitioner in case FIR No.57 dated 26.03.2023 under Sections 307/452/506/148/149 of the IPC and Sections 25/27 of the Arms Act, 1959 registered at Police Station Ajnala, Amritsar. 2.
Mr. Naveen Bawa, Advocate, has entered appearance on behalf of the complainant and filed his power of attorney, which is taken on record.
3.
At the outset, learned counsel for the complainant has vehemently opposed the prayer made by the counsel opposite for making the interim order dated 03.04.2024 absolute, which was passed in the following terms, in view of the gross misuse of the said concession by the petitioner:- "On a pointed query put to the learned counsel as to how the instant petition was maintainable since the earlier one had been dismissed on merits, he has PUNEET SACHDEVA 2024.07.10 17:02 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-6728-2024 -2submitted that the earlier petition was dismissed on account of the petitioner's involvement in two other cases under Section 307 of the IPC which had not been mentioned in the FIR, however, instructions received by the learned State counsel were factually incorrect inasmuch as the petitioner was not involved in any other criminal case on that date."
4.
It has been contended by the learned counsel for the complainant that after the petitioner was granted the concession of interim bail by this Court on 03.04.2024, he had yet again physically assaulted the complainant party, as a result of which one more criminal case under Sections 307, 323, 324, 148, 149 of the IPC and Sections 25 and 29 of the Arms Act had been registered against the petitioner vide FIR No.87 at Police Station Ajnala.
5.
Short reply by way of affidavit of Deputy Superintendent of Police, Sub-Division Ajnala, Amritsar (Rural), has been filed in Court, which is taken on record.
6.
Learned State counsel, on instructions from ASI Paramjeet Singh, has not disputed the submissions made by the counsel for the complainant and has admitted that the petitioner had indeed been involved in one other criminal case involving the same parties. 7.
I have heard learned counsel for the parties and perused the relevant material on record.
8.
In the circumstances, petitioner does not deserve the extraordinary concession of anticipatory bail. 9.
The petition, therefore, stands dismissed.
