  CM No. 9757-CII of 2024 A Civil Misc. Application No. 9757-CII of 2024 has been filed on behalf of applicant-petitioner No.2 who wishes to withdraw the present petition. It has been averred that in similar situation, FAO No. 17 of 2021 filed by the applicant-petitioner No.2 has been withdrawn as all the disputes between the applicant-petitioner No.2 and the respondents have been settled. Accordingly, the name of applicant-petitioner No.2 is deleted from the array of parties. Application stands disposed of.

The present petition has been filed by the petitioners under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment an arbitrator to adjudicate upon the disputes and differences between the parties. After hearing learned counsel for the parties, vide order dated 05.04.2024 this Court proposed to appoint Justice Rajiv Narain Raina, former Judge of this Court, as the Principal Arbitrator to be assisted by two other members, namely, Shri Navreet Singh Kang, IAS (Retd.), and Shri R.K.Pachnanda, IPS (Retd.). Declaration as required under Section 12(5) of the Act of 1996 was sought from the said arbitrator and two other members. Necessary declarations have now been duly received. 4.

In view of the above, the petition stands disposed of. The order dated 05.04.2024 passed by this Court is made absolute. The nominated Arbitrators shall enter into the reference with the sole petitioner No.1 and the respondents in accordance with law.
