Present:

Mr. Aayush Gupta, Advocate for the petitioner. HARINDER SINGH SIDHU, J Respondent No.6 had filed a complaint at P.S. Majitha, District Amrtisar alleging that the son of the petitioner had received an amount of Rs.26 lacs on the promise to send him to Canada. It is alleged that neither the amount was returned nor was the complainant sent to Canada. Said complaint was inquired into by the S.P (Investigation), Amritsar Rural, who recommended that the complaint be filed. It is stated that respondent No.6 has once again filed similar complaint to the Superintendent of Police (D), Batala. The petitioner against whom there is no allegation of having received money is being repeatedly called by the police and is being threatened to be implicated in a false case.

Without in any way opining on the merits of the case, this petition is disposed of with a direction that in case, presence of the petitioners is required in connection with any inquiry/complaint/investigation, the procedure as per the Code of Criminal Procedure be strictly complied with.
