The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.176, dated 11.11.2025, under Sections 406, 420 IPC, registered at Police Station Division No.7, District Jalandhar.

On 02.02.2026, the Co-ordinate Bench had passed the following order:- "Apprehending her arrest in case FIR No.176 dated 11.11.2025 registered under Sections 406, 420 IPC at Police Station Division no.7, District Jalandhar, petitioner has filed the instant petition under Section 482 BNSS seeking pre-arrest bail.

Learned counsel for the petitioner inter alia submits that the petitioner is innocent and has been falsely implicated in the present case. The story putforth by the complainant in the FIR that the petitioner and other two accused have taken money for sending the son of the complainant to Canada, is totally false and fabricated and as a matter of fact the complainant Kanwaljit Singh Makkar is a commission agent who receives money from abroad and disburses the same in India on commission basis, which is clear from the Whatsapp chat between Shamsher Singh and the petitioner (Annexure P-2, page 38) and also the Whatsapp chat between the complainant and the petitioner (Annexure P-5, page 48).

He further submits that notice under Section 35 of the Bharatiya Nagarik Suraksha Sanhita, 2023 was also not issued to the petitioner, which is in violation of the law laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar and another, 2014(3) R.C.R.(Criminal) 527. He further submits that the petitioner is not involved in any other case and is ready and willing to join the investigation.

In the meanwhile, arrest of the petitioner shall remain stayed. She shall join the investigation and co-operate with the investigating agency and shall not leave the country without prior permission of the Court.

Investigating Officer through learned State counsel is directed to inform the complainant about the pendency of this petition and file compliance report."

Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, she shall make herself available without demur.

Learned State counsel on instructions from ASI Balwinderpal Singh affirms the factum of joining the investigation by the petitioner on 10.02.2026 and cooperating with the investigating agency. She also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 02.02.2026 granting interim bail to her, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to her.
