Advocate General, Haryana. **** This petition has been filed by the petitioner-association being aggrieved by the show cause notices (Annexure P-10 to P-13) issued to it by the respondent-authorities for submitting bank guarantees/F.Ds. with the Director, Medical Education & Research, Haryana, in terms of the policy for establishing Nursing Training Schools/Colleges in the State. Learned senior counsel appearing for the petitioner-association submits that though the impugned show cause notices are labeled as such, however, they are, in fact, the decisions, that have already been taken by the respondent-authorities and the petitioner association has directly approached this Court against the same. He, however, submits that the petitioner association be granted an opportunity to file replies to the show cause notices issued by the authorities.
Learned Additional Advocate General appearing for the respondent-State of Haryana, on advance copy, submits that the respondentauthorities, infact, have already taken a decision in the matter in view of the RAVINDER KUMAR 2023.02.24 15:55 I attest to the accuracy and authenticity of this order/judgment.
[2] fact that none of the petitioners have filed any reply to the show cause notices, though the same has not been communicated to the petitioner or published. He, however, fairly states on a query being made by this Court that in case the petitioners still file replies to the show cause notices within 10 days from today, the authorities would consider and take a decision thereon expeditiously in accordance with law and communicate the same to the petitioner.
In view of the aforesaid circumstances and taking the statements of learned counsel for the parties on record, the petition stands disposed of.
