*** HARSH BUNGER, J. (Oral) This petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking a writ in the nature of Mandamus for directing respondent No.3 to change the date of birth of the petitioner in his passport.

A further prayer has been made for directing the respondents to decide the representations dated 28.12.2024 (Annexure P-19 and P-20), submitted by the petitioner, in a time bound manner. 2.

At the outset, learned counsel for the petitioner submits that against the order/letter dated 10.04.2024 (Annexure P-16), the petitioner has already preferred an appeal before the Appellate Authority i.e. the Joint Secretary (PSP) and the Chief Passport Officer, Passport Division, Ministry of External Affairs, Patiala House, Tilak Marg, New Delhi and the same is pending consideration for 17.02.2025.

CWP-2832-2025 (O&M) -22.1 Learned counsel for the petitioner submits that he may be permitted to withdraw the instant writ petition, however time bound directions be issued to the Appellate Authority to decide the appeal, filed by the petitioner, which is pending consideration for 17.02.2025. 3.

Learned counsel appearing for the respondent(s)-Union of India submits that in all probability the appeal filed by the petitioner shall be considered and decided by the concerned Appellate Authority on the date fixed i.e. 17.02.2025 and in any case, not beyond a period of one month thereafter, after affording due opportunity of hearing to all the concerned parties.

In view of the submissions made by the respective parties, the instant writ petition is dismissed as withdrawn, however, it is directed that the Appellate Authority shall consider and decide the appeal filed by the petitioner against the order/letter dated 10.04.2024 (Annexure P-16) on the date fixed i.e. 17.02.2025 and in any case, not beyond a period of one month thereafter, after affording due opportunity of hearing to all the concerned parties.
