The present petition has been filed under Section 482 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.27 dated 19.03.2023 registered under Sections 341, 323, 506 IPC (Section 308 IPC added later on) registered at Police Station, Nandgarh.

Learned counsel for the petitioner inter alia contends that the son of the complainant suffered injuries in a road accident and the offence under Section 308 IPC has been added after a gap of 2 1⁄2 months from the date of occurrence and custodial interrogation of the petitioner is not required, as nothing is to be recovered from him. He is the only earning member of the family and therefore, prays for concession of anticipatory bail. 3.

Mr. Subhash Godara, Addl. A.G., Punjab, who appears on advance notice, on instructions from ASI Chamkaur Singh submits that as per the MLR, five injuries were found on the person of the injured, which were inflicted by the petitioner. Having heard learned counsel for the parties and after perusing the record as well as keeping in view the role played by the petitioner and the gravity of offence, this Court does not find any merit in the prayer sought by the petitioner in the present petition.

Consequently, the instant petition stands dismissed. 6.

However, nothing observed hereinabove shall be construed as expression of opinion of this Court on merits of the case and the trial Court shall proceed without being prejudiced by observations of this Court.
