*** MANOJ BAJAJ, J. (Oral) Petitioner has approached this Court under Section 438 Code of Criminal Procedure to seek anticipatory bail in case FIR No.68 dated 06.04.2020 under Sections 324, 323 read with Section 34 of Indian Penal Code, 1860 (Section 326 IPC added later on) registered at Police Station Amargarh, District Malerkotla, who apprehends his arrest at the hands of Police.

Learned counsel for the petitioner has argued that the alleged occurrence took place between neighbours and as per FIR complainant Harpreet Kaur had named four persons including the petitioner and out of those, two have already been declared innocent. CRM-M-7049-2022 -2of the co-accused namely Mal Singh has already been released on anticipatory bail. According to him, the petitioner also suffered injury in the said occurrence and cross case was registered through DDR No.052 dated 07.04.2020.

Learned State counsel assisted by ASI Amrik Singh does not dispute this fact that the petitioner also suffered injury on her back and the injury suffered by Harpreet Kaur is on the right little finger. Considering above background, nature of offence as well as the role attributed to the petitioner, this Court, without expressing any opinion on the merits of the case, does not find it to be a fit case for custodial interrogation of the petitioner.

Resultantly, the petition is allowed and it is ordered that in the event of arrest, the petitioner shall be admitted to interim bail on her furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer.
