Petitioner- Jasmeen Kaur, has approached this Court for issuance of a direction to the respondents not to harass her, her husband and his family members, in the garb of FIR No. 6 dated 22.1.2021, for offence under Sections 363, 366, 366-A, 120-B IPC, registered at Police Station Mehna, District Moga, got lodged by her mother Paramjit Kaur.
A perusal of the FIR goes to show that complainant Paramjit Kaur had lodged the FIR in question against Gurvinder Singh @ Sema, Amandeep Singh @ Sunny, Nikka Singh and one un-known person, on the allegations that Gurvinder Singh @ Sema in connivance with his brother Amandeep Singh @ Sunny, Nikka Singh BANITA CHUGH 2021.02.19 14:16 I agree to specified portions of this document
CRM-M-7963 of 2021 -2and one un-known person, had kidnapped her daughter Jasmeen Kaur, aged 17 years, a minor girl, by giving her allurement. The petitioner claims that she is aged 18 years, with her date of birth to be 21.7.2002 and she has got married with Gurvinder Singh and the police is unnecessarily harassing her husband and member of in-laws family.
The petitioner can very well appear before the Investigating Officer and produce evidence with regard to her majority at relevant time and having married Gurvinder Singh of her own and if she is successful in proving that she had attained majority at the time of her alleged kidnapping and she has married with Gurvinder Singh of her own, then no offence would be made out.
As such the petitioner is relegated to the remedy of approaching the Investigating Officer and apprise him of her version. The petition stands disposed of accordingly.
