The petitioner has approached this Court seeking grant of regular bail in respect of a case registered against him vide FIR No.18 dated 23.1.2022, Police Station Patran, District Patiala under Section 61/1/14 and 78(2) of Excise Act, wherein it is alleged that the petitioner was found in possession of 47 boxes of liquor containing a total of 564 bottles of country made liquor, which he was possessing without any license or authorization. 2.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case and that, in any case, since the recovery already stands effected and investigation is almost complete, he is entitled to be released on bail.

On the other hand, learned State counsel has informed that since the petitioner stands involved in one more case under Excise Act, there is likelihood that in case released on bail, he would indulge in similar offence again. Learned State counsel upon instructions from ASI Amarjit Singh has, however, informed that the investigation is almost complete and challan is likely to be presented shortly.

I have considered rival submissions addressed before this Court. 5.

It is a case of recovery of 47 boxes of country made liquor containing a total of 564 bottles. The investigation is stated to be almost complete. The petitioner has been behind bars since the last about 2 months. In these circumstances, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
