The present petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 20.10.2023 passed by the learned Principal Judge, Family Court, Phagwara, District Hoshiarpur whereby maintenance pendente lite has been granted to the respondent herein under Section 24 of the Hindu Marriage Act, 1955.

In view of the judgment dated 24.01.2024 passed by the Division Bench of this Court in FAO-5930-2023 titled as Rajni V/s Mohit, the impugned order is amenable to appeal under Section 19(1) of the Family Courts Act.

Faced with the same, the learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a First Appeal against the Order.
