**** RITU BAHRI , J. (Oral) Petitioner is seeking direction to the respondents to allow annual increments to them w.e.f 01.08.2005 as the same were withheld because of nonpassing of type test whereas as per policy dated 21.06.1990 (P-3) the dependents to the deceased employees appointed under Ex Gratia scheme are not require to pass type test if they are matric with 1st or 2nd Division. It has remained undisputed that the relief sought by the petitioner in the above writ petition had already been sought by another applicants/petitioner before this Court in CWP No. 6709 of 2016 titled as Smt. Sudesh Kumari vs. UHBVNL and others, decided on 06.07.2018. The aforesaid petition was allowed by interpreting Rules and Regulations. Issue notice of motion Mr. Deepak Manchanda, Advocate, who is present in the Court accepts notice on behalf of the respondent-Nigam. Learned counsel for the petitioner shall supply copy of the petition to learned State counsel by today itself.

CWP No. 3312-2019 Learned counsel for the respondent has admitted that no LPA has been filed against the above judgment dated 06.07.2018. Therefore, for the parity of reasoning, this petition is allowed in terms of the judgment dated 06.07.2018 rendered in CWP No. 6709 of 2016. The exercise shall be completed within a period of four months from the date of receipt of certified copy of this order.
