Mr. Navdeep Singh, Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.197 dated 01.11.2023 under Sections 406, 420 of the IPC registered at Police Station Sadar Jalandhar. 2.

Vide order dated 08.02.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner inter alia contends that the case in hand rests on documentary evidence; false allegations have been levelled against the petitioner of having intentionally deposited a cheque in the sum of `5 lakhs which was given to him by the complainant, in the name of one lady Baljinder Kaur. Learned counsel submits that the petitioner has clean antecedents and is ready to join investigation and cooperate with the investigating agency moreso since no recovery is required to be effected from him." Learned counsel for the petitioner submits that in compliance of order dated 08.02.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation. It has also not been disputed that the petitioner does not have any criminal antecedents.

In view of the above, the petition is allowed and interim order dated 08.02.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
