Learned counsel for the petitioners states that petitioner No.2 - Ashok Kumar - who has been running a business in the demised premises for the last 30-35 years, be granted one year's time to vacate the premises and to look for alternate premises. Learned counsel has further stated that the entire arrears of rent has already been deposited in the Court of learned Rent Controller. He has further stated that petitioner No.2 is willing to pay rent at the rate of Rs.1500/- per month by the 7th of every month. Learned counsel for the respondent, on instructions from the Jagga Mall, power of attorney of the respondent, who is present in Court, states that he has no objection if the petitioner No.2 is permitted to retain the premises for a period of one year from today provided he hands over the TRIPTI SAINI 2022.05.25 22:23 I attest to the accuracy and authenticity of this order/judgement
CR-662-2022 (O&M) -2vacant possession of the premises by 24.05.2023 and subject to his paying the rent at the rate of Rs.1500/- per month by the 7th of every month. The statements of both the parties have been recorded separately.
In view of the statements made by the counsels and the parties present in Court, the petitioner No.2 is permitted to retain the premises for a period of one year from today and would hand over the vacant possession of the premises by 24.05.2023. The petitioner No.2 shall pay rent at the rate of Rs.1500/- per month by the 7th of every month. The respondent would be at liberty to withdraw the rent deposited by the petitioner No.2 in Court. Parties shall remain bound by their statements.
Disposed off accordingly. All pending applications, if any, also stand disposed off.
