Ishab Khan & ORS. v. State Of Hry.
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-9156-2003 Date of decision: 19.12.2022 Ishab Khan and others ....Petitioners Vs.
State of Haryana and others
...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA Present: Mr. Sandeep Dhull, Advocate, For the petitioners.
Mr. R.D.Sharma, DAG, Haryana.
*** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari for quashing impugned order dated 06.06.2003 (Annexure P-22) vide which services of the petitioners as Fisherman were ordered to be terminated with immediate effect.
2.
Petition was admitted for hearing on 13.07.2004. 3.
When taken up for final adjudication, learned counsel is unable to assist the Court for lack of instructions. Learned counsel for the petitioners states that despite repeated attempts, his office could not contact the petitioners. Particulars of the address given as per the 'Memo of Parties' reflect that on the given office address service may not be possible as no residential address and/or any specific particulars thereof have been given and it is merely an office address where at the relevant time petitioners were serving. In the premise, no useful purpose would be served by issuing fresh notice to the petitioners as the same too would be an exercise in futility. VANDANA 2022.12.21 18:25 I attest to the accuracy and integrity of this document
4.
It seems that by sheer effluxion of time and pendency of the writ petition for more than 19 years before this Court, either it has been rendered infructuous or else the petitioners seem to have lost interest in pursuing the same.
5.
Be that as it may, writ petition is dismissed with liberty to the petitioners to file an appropriate application in case any cause of action still survives.
6.
Pending application, if any, shall also stand disposed of. (ARUN MONGA) JUDGE December 19, 2022 Vandana Whether speaking/reasoned:
