ANOOP CHITKARA , J. (Oral) Interim bail under section 483 [BNSS] FIR No.

Dated Police Station Sections 08.10.2024 Chheharta, District Amritsar 21(c) of NDPS Act Petitioner incarcerated in the FIR captioned above, came before this Court for grant of interim bail for 15 days on the ground of marriage of his real sister which is scheduled for 06/07.02.2025. 2.

Status report by way of affidavit on behalf of the State has been handed over in the Court today and the same is taken on record. Copy thereof has been supplied to counsel for the petitioner. 3.

State counsel while referring to the status report submits that the quantity recovered from the petitioner and his co-accused is commercial i.e. more than 65 kgs heroin. Petitioner is at flight risk and if this Court grant interim bail to the petitioner then there is possibility of the petitioner to abscond from the process of law.

On the other hand petitioner's counsel submits that the marriage of the real sister of the petitioner is scheduled on 06th and 07.02.2025 and petitioner has to fulfill his social obligation. However, State counsel opposes MAMTA 2025.02.06 10:08 I attest to the accuracy and integrity of this order/judgment

CRM-M-5948-2025 -2the bail and submit that the petitioner be permitted to attend the marriage in police custody.

Given above, present petition is disposed of with the direction to the concerned the Superintendent of Police to allowed the petitioner to attend the marriage on 06/07.02.2025 as per schedule of the marriage in police custody. He/she will ensure that the petitioner shall join the function and return in jail timely. Expenses incurred in visiting the accused at the venue shall be borne by the State Exchequer.
