        CRR(F) 224 of 2023 The petitioners, through the instant petition are seeking modification of order dated 04.11.2022 whereby Principal Judge Family Court, Yamuna Nagar at Jagadhri has allowed interim maintenance of Rs. 4,000/- per month to petitioner No.2-minor daughter of the respondent and no maintenance has been awarded to petitioner No. 1-wife.

The brief facts of the case are that marriage of petitioner No. 1 was solemnized with respondent on 02.02.2020 as per Sikh rites and rituals. A female child was born out of this wedlock. CRR(F)-224 of 2023(O&M) -2petitioner-wife filed petition under Section 125 Cr.P.C., before Family Court, Jind, seeking maintenance. The Family Court vide impugned order dated 04.11.2022 has awarded interim maintenance of Rs. 4,000/- per month to petitioner No. 2 whereas no maintenance has been awarded to petitioner No. 1-wife.

Learned counsel for the petitioners, at the outset, submits that Family Court without appreciating earning of the respondent which indubitably is Rs. 31,132/- per month, has determined interim maintenance of Rs. 4,000/- per month to petitioner No. 1 and no maintenance has been awarded to the wife The Family Court may be directed to expedite the determination of final maintenance. I have heard counsel for the petitioners and perused the records.

The marriage of the petitioner with the respondent is undisputed. The respondent is working in Electricity Department as Supervisor in Delhi and getting salary of Rs. 31,132/- per month. Without commenting on merits of the case, the Family Court, Yamun Nagar at Jagadhri, is requested to expedite determination of final maintenance and preferably within three months from the date of receipt of certified copy of this order. Disposed of.
