Learned State counsel on instructions from ASI Jaswinder Singh has submitted that during the course of investigation Section 306 IPC has been deleted and Section 304-B IPC has been invoked in the F.I.R in question. Faced with the situation, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh on the same cause of action with better particulars. Permission is granted. The present petition is dismissed as withdrawn with liberty as aforesaid.
