The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue him passport.

Counsel for the petitioner inter alia contends that petitioner is a minor. His father passed away on 12.07.2019 and Civil Court vide order dated 26.05.2022 (Annexure P-1) has granted his custody to his grandfather. The mother of the petitioner has relinquished her right of custody. The grandfather of the petitioner is a permanent resident of Canada. The petitioner through his grandfather has applied for re-issuance of passport. 3.

Ms. Ruchita Garg, Advocate, submits that passport authority has issued notice dated 07.03.2024 calling upon the petitioner to submit information as mentioned in the said notice. If the petitioner submits PARAMJIT KAUR SAINI 2024.03.13 04:03 I attest to the accuracy and integrity of this document

CWP No.2923 of 2024 -2- 2024:PHHC:035570 requisite information and appears on the appointed day, the competent authority would adjudicate application of the petitioner, in accordance with law.

Mr. P.S.Punia, Advocate, asserts that petitioner would file reply to the aforesaid notice and appear before the passport authority alongwith his grandparents. He would also produce copy of the order dated 26.05.2022 passed by Additional Principal Judge, Family Court, Ludhiana, whereby grandfather of the petitioner has been appointed guardian. 5.

In the wake of statement of both sides, the present petition stands disposed of with a direction to petitioner to appear before passport authority on 10.04.2024 alongwith requisite documents. The passport authority would adjudicate application of the petitioner within six weeks from 10.04.2024.
