**** ALOK JAIN, J. (Oral) The present petition is for grant of regular bail to the petitioner in case FIR No. 100 dated 16.03.2022 under Sections 365/328/376-D of the Indian Penal Code, 1860, registered at Police Station Punhana, District Nuh.

After arguing on the merits of the case, learned counsel for the petitioner has submitted that all the material witnesses have been examined. However, learned State counsel has vehemently opposed the bail on the ground that there is sufficient medical evidence on the file and it a case of Section 365 IPC, whereby the prosecutrix was kept in custody for multiple days and was subjected to gang rape after injecting some sedative. He further submits that the co-accused Mubarik and Irfan are still evading their arrest and have not come forth. PARUL 2023.04.21 10:35 I attest to the accuracy and authenticity of this document

At this stage, counsel for the petitioner prays for withdrawal of the present petition with a request that the trial Court be directed to adjudicate the matter expeditiously.

Learned State Counsel submits that the matter is fixed for 27.04.2023 before the Court below.

In light of the above, the present petition stands dismissed as withdrawn, however, the trial Court is advised to expedite the trial.
