Today, none appears for the appellant. None had put in appearance on 16.01.2023 and direction was issued to inform the counsel for the parties. As per office report, learned counsel for the appellant as well as counsel for respondent No.2 have been informed. 2.

Learned counsel for subsidiary of respondent No.2 points out that the dispute as such was regarding transfer of 51% shares in favour of the petitioner company in terms of the guarantee agreement-cum-agreement to pledge dated 10.02.1999. The same was declined by learned Company Judge vide order in appeal dated 20.12.2001. Keeping in view the period gone by, we are of the considered opinion that the petition has rendered infructuous over the period of time, as even learned counsel for the appellant has not been appearing.

Accordingly, we dismiss the present appeal for want of prosecution.
