(ORAL) CRM-18898-2023 Prayer in this application filed under Section 482 Cr.P.C. is for fixing actual date of hearing in the main appeal which was admitted by this Court vide order dated 12.09.2018, as the present appeal stands abated, as the appellant had expired on 01.11.2020. Learned counsel for the applicant-appellant submits that appellant-Amit had preferred the present appeal against the judgment of conviction dated 02.08.2018 and order of sentence dated 04.08.2018. During the pendency of appeal, appellant had died on 01.11.2020. Copy of death certificate dated 14.12.2020 is appended as Annexure A-1. Learned counsel for the State confirms the aforesaid fact in view of assertions made in para 3 of the reply filed by the respondentState wherein it has been stated that on enquiry it has been found that the RISHU KATARIA 2023.09.12 18:06 I attest to the accuracy and authenticity of this order/judgment

For the reasons stated in the application, the same is allowed and the main appeal is listed for hearing today, itself. CRA-S-3561-SB-2018 For the reasons noted above and with the consent of learned counsel for the parties, this appeal is taken up for hearing today itself. Since, the sole appellant in the present appeal had admittedly, died on 01.11.2020 as is evident from the death certificate dated 14.12.2020 (Annexure P-1), proceedings in the present appeal stand abated qua the appellant.
