******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner submits that in a complaint filed by respondent no. 2 under Section 138 of the Negotiable Instruments Act, the petitioner was never served, as such, he could not appear before the trial Court. The offence is bailable. The petitioner will appear before the trial Court and furnish the bail bond.
As the petitioner is stated to have never appeared before the trial Court in the complaint under Section 138 of the Negotiable Instruments Act and has also not violated any terms and conditions of bail granted to him, he is at liberty to surrender before the trial Court and furnish the bail bond.
This petition is not maintainable, as such, the same is dismissed.
