RAJESH BHARDWAJ, J.(ORAL) Instant is the second petition filed under Section 438 Cr.P.C. praying for grant of anticipatory bail to the petitioner in case FIR No.130, dated 05.08.2021, under Sections 363, 366-A, 376, 506, 120-B IPC and Section 6 of POCSO Act, registered at Police Station Sadar Hoshiarpur, District Hoshiarpur, Punjab.

Notice of motion.

On asking of the Court, Mr.Sandeep Kumar, DAG, Punjab, who is present in Court, accepts notice on behalf of the respondent-State. He has submitted, on instructions from ASI Balbir Singh, that the petitioner was declared P.O. vide order dated 11.10.2022.

Counsel for the petitioner submits that this Court vide order dated 06.02.2023 already quashed the order dated 11.10.2022 declaring him P.O..

This Court has perused the order dated 06.02.2023 passed by a Coordinate Bench, relevant para of which reads as under: MEENU 2023.02.10 10:25 I attest to the accuracy and integrity of this order/judgment

CRM-M-6855-2023 -2- " Orders dated 11.10.2022 (Annexure P-16) is set aside and the petitioner is directed to appear before learned Trial Court on or before 10.3.2023. On the petitioner putting in appearance before the trial Court, the trial Court shall release him on bail on his furnishing bail bonds to its satisfaction." The relief sought has already been granted by Coordinate Bench by directing the trial Court to release the petitioner on bail on furnishing his bail bonds to its satisfaction, if he appears before it on or before 10.03.2023. Counsel for the petitioner prays for withdrawal of this petition with liberty to pursue his remedies, as already directed by this Court. Allowed as prayed for.

Petition is dismissed as withdrawn with aforesaid liberty. February 09, 2023 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
