The petitioner prays for release of the compensation, assessed by the Arbitrator, nominated under the National Highways Act, 1956 (hereinafter referred to as the "1956 Act").

As per the provisions of the 1956 Act, the provisions of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as "the 1996 Act"), are applicable. Section 36 of the 1996 Act do enable the parties to enforce the award like a decree of a Civil Court. 3.

In view of the above, the present writ petition is disposed of by relegating the petitioner to the alternative remedy. (Anil Kshetarpal) Judge February 25, 2022 "DK"
