Learned State counsel on instructions from SI Kulwinder Singh submits that proclamation order is already dismissed by the co-ordinate Bench of this Court. After that the petitioner had surrendered and was released on regular bail. He further submits that the only prayer in this petition is to arrest the accused because he was declared as proclaimed offender and as such, nothing survives in this petition. Learned counsel for the petitioner submits that although the earlier petition bearing CRM-M-37523-2016 filed by the accused for setting aside the proclamation order was dismissed for want of prosecution vide order dated 28.02.2020. Be that as it may, he has surrendered before the trial Court.

He further submits that given the entirety of the facts, deliberate attempt was made to delay the trial, he would be satisfied if an order is passed to expedite the trial. Since the FIR is of 2010, this Court requests the learned trial Court to expedite the trial. No other order is required to be passed in this petition. The present petition is disposed of. All pending applications, if any, stand disposed of.
