Present petition has been filed under Section 482 Cr.P.C for quashing of order dated 17.08.2019 passed by the learned Sub Divisional Judicial Magistrate, Kosli as well as order dated 07.01.2020 passed by the learned Additional Sessions Judge, Rewari.

Today, respondent No.2 appeared in person and submitted that he has no objection if the present petition is allowed and orders dated 17.08.2019 and 07.01.2020 are quashed. However, learned State counsel opposed the said submission.

I have heard learned counsel for the parties and perused the record.

A perusal of the file reveals that an application under Section 319 Cr.P.C. for summoning the accused/petitioners, namely Naresh Kumar and Rajesh Kumar, sons of Shri Kanwar Lal, was filed by Nar Singh (respondent No.2). The said application was allowed vide order dated 17.08.2019 passed by TRIPTI SAINI 2026.01.30 17:09 I attest to the accuracy and integrity of this document

CRM-M-5743-2020 (O&M) -2the learned Sub Divisional Judicial Magistrate, Kosli. The revision petition filed thereagainst was dismissed vide order dated 07.01.2020 by the learned Additional Sessions Judge, Rewari.

In view of the statement made by respondent No.2 - Nar Singh, order dated 17.08.2019 passed by the learned Sub Divisional Judicial Magistrate, Kosli, and order dated 07.01.2020 passed by the learned Additional Sessions Judge, Rewari, are hereby set aside. Consequently, the present petition is allowed.
