(ORAL) [1] Status report by way of affidavit of Shri Laskhwinder Singh, PPS, Deputy Superintendent of Police, Sub Division Dhar Kalan, District Pathankot, on behalf of the respondent-State has been filed in Court today. The same is taken on record. Copy thereof has been supplied to learned counsel opposite.
[2] On 08.02.2024, the following order was passed by this Court:- " Present:
Mr. S.K. Choudhary, Advocate for the petitioner. **** Prayer in this petition is for grant of anticipatory bail under Section 438 Cr.P.C in case FIR No.108 dated 08.09.2023 registered under Sections 304, 120-B of the IPC registered at Police Station Sujanpur, District Pathankot.
At the outset, learned counsel for the petitioner contends that coaccused Monty has been given the benefit of interim pre-arrest bail by this Court vide order dated 06.11.2023 passed in CRM-M-55932-2023 (Annexure P-2). The interim pre-arrest bail was made absolute vide order dated 13.12.2023. It is also contended that another co-accused Janam @ Jannu was also granted the benefit of interim pre-arrest bail by this Court vide order dated 16.12.2023 passed in CRM-M-63488-2023. Learned counsel contends further that the case of the petitioner is on better footing RAJNEESH SHARMA 2024.02.20 05:11 I attest to the accuracy and integrity of this document
2024:PHHC:023213 CRM-M-6741-2024 -2as he is not named in the FIR. Apart from this, one more similarly placed co-accused Karam Din was also given the benefit of interim anticipatory bail by this Court vide order dated 05.02.2024 passed in CRM-M-59342024 (Annexure P-3). Notice of motion.
Mr. Anmol Singh Sandhu, AAG, Punjab accepts notice on behalf of respondent- State.
Adjourned to 20.02.2024 for filing status report. Be listed along with CRM-M-5934-2024.
In the meantime, in case of arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/Investigating Officer. However, it is directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C. " [3] Today, learned State Counsel, on instructions from ASI Sushil Kumar, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 08.02.2024 and is no longer required for further investigation.
[4] In view of the aforesaid, the order dated 08.02.2024, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
