(Oral) CRM-W-402-2022 The instant application has been filed on behalf of the applicantpetitioner seeking issuance of a direction to the designated Medical Board as per provision of Clause 2(e) of the Policy dated 12.4.2002 (Annexure P-11) and for deciding his matter afresh by taking into account the report of the Medical Board.

Learned counsel for the applicant submits that in case the petitioner is got examined by a Medical Board in terms of provisions of Clause 2(e) of Policy dated 12.4.2002 (Annexure P-11), the matter may be considered by the authorities concerned and this petition can be disposed of accordingly.

- 2 - CRWP-1602-2022 (O&M) In view of the aforesaid submission, the main case which is fixed for 15.7.2022 is preponed and is taken on Board today. Main case Keeping in view the submissions made on behalf of the petitioner and while noticing that the State in its reply has not disputed that the petitioner is indeed suffering from multiple ailments, a direction is hereby issued to get the petitioner examined from a designated Medical Board, as per provisions of Clause 2(e) of Policy dated 12.4.2002 (Annexure P-11) and such report be considered by the authorities concerned to examine the case of the petitioner for his premature release. A copy of this order be conveyed to respondent No.3-The Superintendent, District Jail, Faridabad, who shall coordinate with the medical authorities for getting the petitioner examined by the designated Medical Board for getting the needful done.

It is further directed that after the petitioner is got medically examined by designated Medical Board, the authorities concerned shall consider his matter for pre-mature release and dispose of the same expeditiously preferably within a period of 3 months. The petition stands disposed of accordingly.
