Feeling aggrieved by the judgment and order of sentence dated 17.02.2016 passed by learned Judge, Special Court (Sessions Judge), Faridkot whereby the appellant was convicted under Section 18 of NDPS Act, 1985 and sentenced to undergo rigorous imprisonment for a period of one month and to pay a fine of Rs.3000/- and in default thereof, to further undergo rigorous imprisonment for two months, the appellant has come up before this Court by way of filing the present appeal.

At the outset, learned counsel for the appellant contends that he does not want to pursue the present appeal for his acquittal. 3.

Custody certificate dated 15.05.2025 has been filed in Court today and the same is taken on record vide which the appellant has undergone actual custody period of 29 days, out of 01 month of sentence awarded in the present FIR.  4.

Since the appellant does not want to pursue the case for his acquittal, no further orders are required to be passed.
