Mr. Kartar Singh Malik-I, Advocate for the petitioner. VINOD S. BHARDWAJ , J (ORAL) Challenge in the instant petition is to impugned order dated 20.01.2025 (Annexure P-2) passed by respondent No.2 whereby the services of the petitioner have been transferred from CHC Dighal, Jhajjar to CHC Dubaldhan, Jhajjar.

Ms. Tanisha Peshawaria, DAG, Haryana, who is already on an advance notice, informs that the petitioner has been transferred within the same District to a place which is also at equi-distant from the PGI, Rohtak. She submits that the petitioner was working at the same station since 2015 and transfer has been made due to her long stay after taking necessary administrative approval. Counsel for the petitioner does not dispute that the petitioner has been working at the same station for the last 10 years. He, however, contends that the petitioner did not make any request for her transfer and thus the impugned transfer order has been made without her consent or request. On being confronted that in the event of non making any request for seeking transfer from one place to another by an employee, he/she would be entitled to the allowance including T.A/D.A as are admissible to a government MANOJ KUMAR 2025.02.05 00:21 I attest to the accuracy and authenticity of this order

CWP No.2851-2025 #2# employee, learned State counsel fairly concedes that the case of the petitioner for disbursement of all requisite benefits admissible on transfer shall be considered, in accordance with law.

Petition is accordingly dismissed. However, the respondents are directed to consider the claim of the petitioner for grant of all the allowances, as are admissible to an employee on transfer and release the same to her subject to her furnishing requisite bills.
