and the claim petition i.e. MACP-135-2023, is transferred from Jalandhar to Motor Accident Claims Tribunal, Ferozepur.
The present application has filed at the behest of Paramjit Kaur and her children, for seeking transfer of the petition i.e. MACP-135-2023, titled 'Paramjit Kaur and others v/s Kailash Chandra and others', pending in Motor Accident Claims Tribunal, Jalandhar and they seek transfer of the same to Motor Accident Claims Tribunal, Ferozepur. It is submitted by the counsel for the applicants that the applicant No.1 is the widow of the deceased, Sukhjit Singh, who died in a motor vehicular accident. Earlier, she had filed claim petition, while she was residing in the matrimonial house at Jalandhar. However, now she has shifted to Guruharsahai, District Ferozepur, along with her children. In this context, she is seeking transfer of the pending claim petition. On query by the court, it is submitted by the counsel for the applicants that the case is still at the stage of recording of the evidence of the claimant.
Considering the averments made in the application and also no objection, being there by the driver as well as the parents-in-law of applicant No.1 and considering the distance between the two places as well as applicant No.1 taking care of the minor children, the transfer application is allowed and the petition i.e. MACP-135-2023, titled 'Paramjit Kaur and others v/s Kailash Chandra and others', stands transferred from Motor Accident Claims Tribunal, Jalandhar, to Motor Accident Claims Tribunal, Ferozepur. The requisite record of the aforesaid case be sent by Motor
Accident Claims Tribunal, Jalandhar, to District & Sessions Judge, Ferozepur.
Learned District and Sessions Judge, Ferozepur, shall assign the said petition to Motor Accident Claims Tribunal, Ferozepur. Even, the parties are directed to appear before Motor Accident Claims Tribunal, Ferozepur, within a period of one month from today onwards.
