(Oral) The petitioner has approached this Court for raising a challenge to the charge-sheet dated 13.04.2000 (Annexure P-2) and any subsequent proceedings taken in pursuance thereof and a further prayer to quash the instructions contained in Head Office Letter no. S&S/RL/35(1)/85 dated 09.05.1985 (Annexure P-3). Learned counsel appearing on behalf of the petitioner contends that due to erroneous instructions, he had made statement before this Court that a final decision could not be taken by the competent authority in the regular departmental enquiry initiated against the petitioner due to interim order passed by this Court. He

CWP-1038-2001 (O&M) -2contends that the petitioner was dismissed from service on 31.08.2006 on account of punishment imposed and other disciplinary proceedings. He has thereafter passed away on 10.11.2008. He thus submits that since the petitioner has already passed away, hence, no further order is required to be passed on the charge sheet that has been served upon the petitioner and the said proceedings have been dropped. In view of the aforesaid statement, the present writ petition is disposed of.

All the pending miscellaneous application(s), if any, are also disposed of.
