CRM-M-5849-2019 (O & M) Date of decision: 08.05.2019 Karamjit Singh @ Karma .... Petitioner V/s State of Punjab

...Respondent(s)

CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Vikas Gupta, Advocate, for the petitioner. Mr. Nikhil Chopra, Addl.A.G., Punjab.

***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner registered against him vide FIR No.66 dated 13.12.2016 under Sections 307, 326, 324, 323, 325, 148, 149, 506, 341, and 120-B IPC at Police Station Valtoha, District Tarn Taran. Petitioner is stated to be in custody since 20.05.2017 and trial has not made much headway. Out of fifteen witnesses only one prosecution witness has been examined, who has turned hostile. Keeping in view period of incarceration of the petitioner and the fact that the trial may still take some time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of the trial court.
