*** Counsel appearing for the applicant-appellant submits that the present application was filed against acquittal in the year 2012 and they have a very good case on merit.
On the contrary, respondent's counsel submits that the judgment of acquittal is well reasoned and leave to appeal should not be granted. He further submits that in case, this Court grants leave to appeal and admits the main appeal, its turn will not come for hearing for decades, as such pendency of the appeal may be treated inconsequential for the respondent. Leave to appeal is granted.
The accused to execute a bond for attendance within two months, undertaking to appear in this court, in case the appeal is allowed. Given above, within two months, the accused-respondent No.2 shall furnish a personal bond of Rs. Ten Thousand only (INR 10,000/-), to the satisfaction of the concerned Trial Court/Duty Magistrate. However, perusal of Memo of parties reveals that respondent No.1 is a Company. As such, furnishing personal bonds is ordered to the extent of respondent No.2 only.
The attesting officer shall, on the reverse page of personal bonds, mention the permanent address of the accused along with the phone number(s), WhatsApp number (if any), e-mail (if any), and in case of any change, the Accused shall immediately and not later than 30 days from such modification, intimate about the change of residential address and change of phone numbers, WhatsApp number, e-mail accounts, to the Registry of this Court.
