Aggrieved by the impugned order dated 07.11.2023 passed by the Special Judge, Mansa, vide which the charges u/s 7, 13(1)(a), 13(2) of PC Act and 120-B, 420, 467, 468, 471 IPC, were framed against the petitioner and other co-accused, petitioner has come up before this Court by filing the present petition. 2.

After arguing for considerable time and facing the strict opposition from State of Punjab, petitioner's counsel wants to withdraw the present petition with liberty to file a fresh petition u/s 482 CrPC in case verdict of Hon'ble Supreme which is pending before larger Bench on the question of Section 17A of PC Act is answered in his favour. 3.

Given above, petition is disposed of as withdrawn with liberty as prayed for. It is clarified that since the petitioner is seeking liberty to file a fresh petition only on the question of law, State shall not object to the delay in filing of petition, if the petitioner files a fresh petition after decision on the question of Section 17A of PC Act.
