**** RAJ MOHAN SINGH, J. (Oral) Petitioners seek grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.576 dated 08.09.2018 registered under Sections 457, 380 IPC at Police Station Nuh, District Nuh.

At the very outset, learned counsel for the petitioners submits that petitioner No.1 has expired and petitioner No.2 has joined the investigation on 11.02.2020.

FIR was registered on 08.09.2018 in respect of occurrence dated 13.08.2019. Delay in lodging of FIR has not been explained particularly when on the next morning, at about 5.00 AM, family of the accused was allegedly called by the JYOTI YADAV 2021.09.10 17:03 I attest to the accuracy and integrity of this document

CRM-M No. 5897 of 2020 -2complainant and they started abusing the complainant party. FIR was not registered even on seeing the aforesaid incident. Learned State counsel on instructions from ASI Varinder Singh submits that petitioner No.2 has joined the investigation on 17.02.2020 and he is not required for any further investigation in the case.

Prayer qua petitioner No.1 has become infructuous in view of his death. Ordered accordingly.

In view of above, order dated 11.02.2020 is hereby made absolute qua petitioner No.2.

However, petitioner No.2 shall keep on joining the investigation as and when required to do so by the Investigating Officer and shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Disposed of.
