(Oral) The instant Writ Petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing respondent No.3 to initiate necessary proceeding upon recommendation report dated 18.11.2024 and application dated 04.12.2024 (Annexures P-9 and P-10) for suspending respondent No.5 from the post of Sarpanch for violating Section 175 of the Haryana Panchayati Raj Act, 1994 because respondent No.5 is encroacher upon the Panchayat land.

At the outset, learned counsel for the petitioner submits that he may be permitted to withdraw the instant writ petition with liberty to the petitioner to file an application before the concerned Authority in terms of Section 7 of the Haryana Village Common Lands (Regulation) Act, 1961, as regards the alleged encroachment by respondent No.5 (Kamlesh). 3.

In view of the above, the present petition is dismissed as withdrawn with liberty aforesaid.
