(ORAL) By this common order, CRM-M-8324 of 2023 and CRMM-9983 of 2023 are hereby adjudicated as prayer and cause of action are same.

CRM-M- 8324 of 2023 and connected case -2The petitioners, through the instant petitions under Section 407 read with Section 482 Cr.P.C., are seeking transfer of case filed by the petitioner through her mother under Section 125 Cr.P.C. from the Court of Principal Judge, Family Court, Faridkot to Family Court at Malerkotla.

Learned counsel for the parties are ad idem that petition under Section 125 Cr.P.C. titled as "Hezalpreet Kaur vs. Parminder Singh" pending in the court of Ld. Principal Judge, Family Court, Faridkot, at the first instance, may be transferred to District and Sessions Judge, Sangrur who would further transfer to any court of competent jurisdiction at Malerkotla In view of joint statement of parties, the petitions are allowed with following directions :- (i) The Case No. MNT125/1910/2019 dated 03.08.2019 filed under Section 125 Cr.P.C. titled as "Hezalpreet Kaur vs. Parminder Singh" which is pending in the Court of Principal Judge, Family Court, Faridkot, at the first instant, is ordered to be transferred to the District and Sessions Judge, Sangrur who would assign the matter to competent Court of jurisdiction at Malerkotla.

(ii)The Principal Judge, Family Court, Faridkot is directed to transfer record pertaining to the aforesaid case to District and Sessions Judge,

CRM-M- 8324 of 2023 and connected case -2- Sangrur.

(iii)The District and Sessions Judge, Sangrur will assign the said petition to the competent Court of jurisdiction.

(iv)The parties are directed to appear before the District and Sessions Judge, Sangrur on 20.04.2023 at the first instanceand thereafter as directed by said Court.
