DAILY LOK ADALAT BENCH NO.3 CWP-15238-1996 PRTC V/S PRESIDING OFFICER * * * *

Present:

None.

* * * * Mr. PS Brar, Advocate, who filed this writ petition, did not put in appearance on a couple of dates. Notice was, ultimately, issued to the petitioner for today. The notice has been received back duly served. Neither the petitioner nor his counsel has put in appearance.

The Labour Court vide its award dated March 13, 1996 came to a conclusion that the workman is entitled to reinstatement with continuity of service but without back wages. It is apparent from the order dated July 30, 1998 that the workman was allowed to join duty, the relief which the claimant had sought. This, in our view, renders the writ petition infructuous.

However, as none has put in appearance on behalf of the petitioner, the writ petition is ordered to be consigned to record with liberty to the petitioner to get it revived, if need be. (G.C.
