(ORAL) This writ petition has been filed by the petitioner being aggrieved by an order dated 24/25.01.2022 (Annexure P-10) passed by respondent No. 3 against which it has a remedy of appeal before the concerned ED (Zone), Food Corporation of India as per paragraph 15 of the Notice Inviting Tender (NIT). When confronted with the aforesaid, learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to avail the remedy of filing an appeal before the concerned authority. He, however, submits that in case the petitioner does so, the concerned authority may be directed to decide the same expeditiously.

Mr. Sunish Bindlish, learned counsel, appearing for the respondents, submits that in case the petitioner does file an appeal within a week, they shall take up and decide it at the earliest in accordance with law. The writ petition stands dismissed as withdrawn with the aforesaid liberty.
