-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.385 dated 11.6.2020 registered under Sections 306 & 34 IPC, at Police Station Rohtak City District Rohtak.

Counsel for the petitioner submitted that the petitioner has joined investigation with the police in the light of previous order dated 17.3.2022 passed by this Court. The counsel for the petitioner further submits that the petitioner is not responsible for the death of Shanker, who GAURAV SOROT 2022.07.26 17:15 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-9541-2022 was having strained relations with his wife Sonia and committed suicide due to the same reason.

The State counsel on instructions from ASI Kuldeep has admitted that the petitioner has joined the investigation and further submits that petitioner is not required by the police for further investigation or for custodial interrogation.

The petitioner is not relative of the deceased or his wife. As per allegations in the FIR, the petitioner was having illicit relations with the wife of the deceased, which fact is matter of evidence. Further, it is matter of evidence as to whether the petitioner played any active role and instigated or abetted deceased-Shanker to commit suicide.

In view of the above and without commenting on the merits of the case, present petition is allowed and order dated 17.3.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
