This petition has been filed under Section 482 Cr.P.C. for quashing of NACT No.165 of 2019 titled as M/s Maman Chand Parmod Kumar vs. Navjyoti Agro and others (Annexure P1) dated 15.02.2019 under Section 138 of Negotiable Instrument Act and summoning order dated 13.06.2019 and all the consequential proceeding arising out of the complaint.

Notice of motion was issued in the present case on 12.02.2020 and in the meantime, proceedings before the trial Court qua the petitioner were stayed. Thereafter, on the next date of hearing i.e. 04.07.2022, there was no representation on behalf of the petitioner, and the case was adjourned to 09.09.2022, on which date the learned counsel for the petitioner had appeared and it was recorded in the order that as per office report, notice could not be issued to the respondents for want of process fee. One week time was granted to file the process fee, and on doing so, fresh notice was ordered to be issued to the unserved respondents for 20.01.2023. CRM-M-6017-2020 (O&M) 2023:PHHC:088505 could not be issued for the same reason of want of process fee and there was also no representation on behalf of the petitioner. Another opportunity of two weeks was granted for the said purpose and the Registry was directed to convey the order to the learned counsel for the petitioner.

As per office report, notice could not be issued for want of process fee and learned counsel for the petitioner had been conveyed in terms of order dated 20.01.2023. However, still none has appeared for the petitioner. It appears that he is not interested in pursuing the present petition.

Dismissed for non-prosecution.
