Ashok Kumar v. Mahabir Singh Ias, Haryana
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH COCP-301-2022 Date of decision: 21.07.2022 ASHOK KUMAR ..Petitioner
Versus
MAHABIR SINGH ..Respondent CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL
Present:
Mr. Sandeep Singh Sangwan, Advocate for the petitioner.
Mr. Harsh Vardhan, AAG, Haryana.
ANIL KSHETARPAL, J(Oral) Complaining wilful violation of the order dated 12.02.2013, passed in CWP-3020-2013, titled as "Ashok Kumar Vs. State of Haryana and others", decided on 12.02.2013. The petitioner has filed the present petition under Section 10 and 12 of the Contempt of Courts Act, 1971. The operative part of the order dated 12.02.2013, is extracted as under:- "Without going into the merits of the case or commenting thereon, the present petition is disposed of with directions to the Director, Secondary Education, Haryana-respondent No.2 to consider and decide the representation dated 27.11.2012 (Annexure P-2) within a period of one month from the date of receipt of certified copy of this order. The decision so taken be conveyed to the petitioner forthwith." The present petition has been preferred in February, 2022 i.e.
after a passage of approximately 9 years. As already noticed, the direction is only to consider and decide representation dated 27.11.2012. Keeping in view the colossal delay, this Court does not find it appropriate to exercise jurisdiction under the Contempt of Courts Act, 1971. Hence, dismissed.
All the pending miscellaneous applications, if any, are also disposed of.
