*** MANOJ BAJAJ, J.(ORAL) This appeal has been filed by three convicts namely Kuldeep Kumar @ Kaka, Amritpal Singh @ Kaddu and Yadwinder Singh challenging the judgment of conviction and order of sentence recorded by the learned Additional Sessions Judge, Mansa in case FIR No.36 dated 01.06.2015 under Sections 399, 402 IPC and Sections 25/54/59 of the Arms Act registered at Police Station City Mansa.
At that stage, the appeal was carrying a delay of 65 days and the same was condoned vide order dated 21.11.2016. At the same time, recovery of fine imposed was also stayed. Notice of motion was issued, however, the convicts never filed any application for suspension of sentence. On 16.04.2018, the present appeal in respect of Kuldeep Kumar @ Kaka and Yadwinder Singh son of Harwinder Singh (appellants No.1 and 3) was treated as infructuous as the custody certificate filed at that stage Sheetal Gawri 2019.04.12 17:22 I attest to the accuracy and integrity of this document Chandigarh revealed that they completed their sentence of imprisonment. CRA-S-4154-SB-2016 (O & M) -2survives only on behalf of appellant No.2-Amrit Pal Singh @ Kaddu son of Harwinder Singh.
Learned State counsel has produced the custody certificate dated 04.04.2019 by way of affidavit of Jaswant Singh Thind, Superintendent, District Prison, Mansa, which indicates that appellant No.2 has also completed his sentence of imprisonment in compliance of impugned judgment of conviction and order of sentence. Resultantly, the present appeal does not survive any more for adjudication on merits.
Disposed off as infructuous.
