CRM-M-7227-2024 This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.39 dated 13.04.2023 registered for the offences punishable under Sections 307, 452, 427, 506, 148, 149 of the Indian Penal Code, 1860 and Section 25, 27 of Arms Act, 1959 at Police Station Kathunangal, District Amritsar. 2.

Custody Certificate of the petitioner has been filed today in Court. The same is taken on record.

Counsel for the petitioner submits that the petitioner has been nominated on the basis of disclosure made by Samandeep Singh @ Raja @ Sanamdeep Singh and Sahildeep Singh. Its a case of no injury. Qua Deepak Kumar 2024.03.13 17:39 I attest to the accuracy and integrity of this document

CRM-M-7227-2024 (O&M) 2024:PHHC:035862 Samandeep Singh @ Raja @ Sanamdeep Singh, the FIR already stands quashed on the basis of compromise vide order dated 28th of August, 2023 passed in CRM-M-31450-2023. The petitioner is behind bars for more than 3 months and 27 days and has clean antecedents. 4.

State Counsel is not in posititon to dispute the factual assertions made by counsel for the petitioner based on record. 5.

I have heard counsel for the parties and have gone through records of the case.

Without commenting on the merits of the case, keeping in view the incarceration already suffered by the petitioner, nature of allegations against the petitioner and the nature of evidence against him, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
