Notice of motion.

Petitioner has approached this court pursuant to a show cause notice Annexure P-7 dated 26.11.2018 herein. Grievance of the petitioner is that he was not afforded any opportunity of hearing before the demand was raised on him.

Mr. Dhuriwala accepts notice on behalf of the State. He submits that grievance of the petitioner shall be examined. In view of the above, we leave it open to the State to consider reply, if any, filed by the petitioner to show cause notice, Annexure P-7. Needless to observe that, in such eventuality, State shall be at liberty to pass appropriate orders after considering the plea of the petitioner.
