PANKAJ JAIN, J. (ORAL) Present petition has been filed under Section 482 Cr.P.C. seeking quashing of the order dated 10th of August, 2023 whereby the petitioner was declared as Proclaimed Person in complaint No. NACT/5959/2019 titled as Harjit Singh vs. Rameet Singh. 2.

The petitioner was summoned to face trial for offence punishable under Section 138 of the N.I. Act. As per the averments made in the petition, the petitioner appeared before the Trial Court and a compromise was effected between the parties on 21st of January, 2020 and the petitioner agreed to pay an amount of Rs.65,000/- which was the balance amount. Petitioner having not been able to comply with the terms of the settlement surrendered before the Trial Court and was released vide order dated 6th of October, 2022. However, again faulted leading to the passing of the impugned order.

While issuing notice of motion on 27.02.2024 following order was passed :

CRM-M-7031-2024 -22024:PHHC:060475 "Counsel for the petitioner has produced copy of bank draft of Rs.45,000/- in order to show bonafide of the petitioner, who has been summoned to face trial in proceedings under Section 138 of Negotiable Instruments Act, out of the balance amount of Rs.65,000/-.

Notice of motion for 30.04.2024.

Mr. Tarun Aggarwal, Sr. DAG, Punjab, appears and accepts notice on behalf of respondent No.1-State.

In the meantime, operation of the impugned order dated 10.08.2023 passed by JMIC, Amritsar (Annexure P-6) shall remain stayed subject to the petitioner appearing before the trial Court on 18.03.2024 and handing over demand draft of Rs.45,000/-. In case the petitioner appears before the trial Court, he shall be admitted to bail, subject to deposit of Rs.45,000/- in form of demand draft. "

Counsel for the petitioner has produced order dated 22.04.2024 to demonstrate that the petitioner in fact appeared before the Trial Court and now admitted to bail. Counsel for the petitioner submits that the petitioner undertakes to appear before the Trial Court without any fault. 5.

Keeping in view that the petitioner already surrendered before the process of law and is attending the trial regularly, in the considered opinion of this Court the impugned order has lost its string and relevance. 6.
