RAMENDRA JAIN, J. (ORAL) Despite the case having been called twice, the petitioner has gone un-represented.
From the perusal of the previous order, it is evident that FIR No. 50 dated 13.02.2008 under Sections 20, 16, 85 of NDPS Act, registered against petitioner-Nepal Singh, has been quashed. But still this petition was kept pending for awaiting decision of Hon'ble the Supreme Court, in Criminal Appeal Nos. 1981 and 1983 of 2009, Virender Vij Vs. State of Haryana.
On instructions from ASI Bahadur Singh, learned State counsel submits that FIR No. 417 dated 17.12.2008, Police Station Hodal, registered against DSP Virender Kumar and ASI Babu Ram, has also been quashed by the Hon'ble Supreme Court. He has produced copy of the order dated 16.03.2015 of the Hon'ble Apex Court, in Court today. The same is taken on record.
In view of the above factual aspect, the instant petition is dismissed as having rendered infructuous and for want of prosecution too.
