Mr. Umesh Aggrwal, Advocate has put in appearance on behalf of the respondent and has filed his memorandum of appearance. On the last date of hearing the following order was passed :- "Learned counsel for the petitioner inter alia submits that vide order dated 25.10.2024 (Annexure P-5), stay was granted by the Appellate Authority and the warrants of possession were stayed. Learned counsel has then referred to the orders dated 06.11.2024, 05.12.2024, 08.01.2025, 17.01.2025 and 27.01.2025 and has submitted that there had been no attempt on the part of the petitioner to avoid arguments and despite that, the Appellate Authority vacated the stay vide impugned order dated 28.01.2025. He submits that now warrants of possession have again been issued to take possession of the demised premises with police help after breaking open the locks. He submits that the petitioner is not interested in delaying the matter and shall argue the matter before the Appellate Authority on the date fixed i.e. 25.03.2025 or even before that if the date is preponed.

In the meantime, operation of the order dated 28.01.2025, vide which the stay granted on 25.10.2024 was vacated, is stayed till the next date of hearing.

This shall, however, not entitle the petitioner to seek any further adjournment before the Appellate Authority and the matter shall be finally argued, as directed by the Court concerned, on 25.03.2025 or a date even prior to the said date, if so deemed appropriate by the Court concerned.

Learned counsel for the parties have informed the Court that the appeal stands disposed of.

In that view of the matter, the present petition has been rendered infructuous and is accordingly disposed of.
